The Fair Work Court Is Coming. What Should Employers Be Thinking About Now?

The Fair Work Court Is Coming. What Should Employers Be Thinking About Now?

The Federal Government has announced plans to establish a new Fair Work Court, designed to provide a specialist pathway for resolving workplace disputes alongside the Fair Work Commission.

The Government says the aim is to make workplace justice simpler, faster and more accessible, with specialist judges hearing workplace relations matters. Consultation on the design of the Court is expected to take place this year.

For employers, however, the more important question isn't about what this looks like; it's:

“What happens when our workplace decisions are tested?”

The dispute is the end of the story

By the time a workplace matter reaches a court or tribunal, the important decisions have usually already been made.

A performance issue has been raised. A grievance has been handled. A disciplinary process has started. A termination decision has been made. The dispute may be the visible event. But the risk often began much earlier.

That's why this announcement should prompt employers to look upstream at the quality and consistency of workplace decision-making happening every day.

Workplace decision-making

Where employers can become exposed

The biggest risk isn't necessarily getting the law wrong. It's being unable to clearly demonstrate how a decision was reached.

Consider:

  • Was the process applied consistently?
  • Was the employee given an opportunity to respond?
  • Can the manager clearly explain the rationale?
  • Is the decision properly documented?
  • Would the same circumstances be handled the same way by another manager?

These questions matter across performance management, disciplinary action, grievances, terminations and other sensitive workplace decisions. And increasingly, the process matters as much as the outcome.

Managers are part of the risk equation

Workplace risk doesn't sit neatly inside HR. Managers make decisions every day that can create (or reduce) workplace risk.

A policy might be clear, but if three managers interpret it differently, inconsistency quickly becomes an issue.

A difficult conversation might not seem significant at the time, but poor documentation can make it difficult to explain the decision later.

An employee concern might appear manageable, but delaying action can allow a workplace issue to escalate.

None of these things necessarily looks like a legal problem when it happens. The risk becomes clearer when the decision is challenged.

Don't wait for the dispute

The proposed Fair Work Court is still to be designed, and there will be plenty of discussion about how it will operate. But employers don't need to wait for every detail to be settled before asking whether their own workplace practices are robust.

  • Do managers know how to handle difficult situations?
  • Are workplace policies applied consistently?
  • Are significant decisions properly documented?
  • Is there a clear escalation process when an issue emerges?
And most importantly: Would your organisation be comfortable explaining how and why a decision was made if it were challenged tomorrow?

The Workvergent view

The workplace relations environment continues to evolve.

New rights. New obligations. New processes. Greater scrutiny.

But the fundamentals haven't changed. Good workplace risk management starts before the dispute. It starts with the everyday decisions leaders make, the capability of managers to handle difficult situations and the systems that support consistent, defensible outcomes.

The Fair Work Court may change what happens when a workplace dispute reaches the next stage. The bigger opportunity for employers is to look at what happens before it ever gets there.

Don't wait for the dispute to expose the gap. Find it first.
